U.S. Treasury Department Previews Forthcoming Treasury and IRS Guidance for Implementation of New Federal Scholarship Tax Credit Program

WASHINGTON, D.C. — Yesterday, the U.S. Department of the Treasury convened education leaders, scholarship granting organizations (SGOs), and stakeholders from across the country for a discussion on the new federal scholarship tax credit program. The discussion emphasized the program’s potential to expand educational opportunity for millions of American students and families beginning in 2027 when the tax credit goes into effect.

During the discussion, Treasury officials provided a preview of forthcoming Treasury and IRS guidance for implementation of the new federal scholarship tax credit. The latest guidance delivers initial clarity on several outstanding implementation issues, providing SGOs and states with the information needed to continue preparing for a successful program launch. We commend the administration’s dedication to building a strong foundation for the program’s long-term success and helping states and SGOs prepare to serve families effectively.

Invest in Education will continue to engage with Treasury officials to address outstanding issues as the Department completes its official draft regulatory guidance expected around the start of the upcoming school year.

The federal scholarship tax credit program empowers parents with greater flexibility to meet their children’s educational needs while expanding access to scholarships that can be used for tutoring, transportation, educational technology, after-school programs, and other eligible educational services.

Anne Lesser, President and CEO of Invest in Education Coalition who attended the discussion said, “Treasury’s preview yesterday provides initial clarity on key implementation issues and helps SGOs prepare for the effective date of this historic law in January 2027. For millions of families across the country, this program represents a once-in-a-generation opportunity to access educational options and resources that best meet their children’s needs. We applaud Treasury for its proactive efforts to keep stakeholders engaged and informed as this new program takes shape.”
